A suspected drink-driver was found “swaying back and forward” next to his car with two Buckfast bottles.

Kieran Farrell, 33, of Thorn Tree Place, Oakley, was banned from driving when he appeared for sentencing at Dunfermline Sheriff Court.

He admitted that on June 17 at Link Road, Oakley, he shouted, swore and made racially offensive remarks towards a police officer.

Then at Dunfermline police station he refused to provide breath specimens.

Depute fiscal Amy Robertson said police received a call about a suspected drink-driver.

Police went to a local shop and found Farrell nearby “swaying back and forward unable to keep his balance”.

He was slurring his words and became hostile to the officers. He said he was a “freeman of the land” and would not be complying with procedures.

He refused to do a breath test and began shouting and swearing, saying “I pay your wages”.

Two Buckfast bottles were on the ground next to his car. After being arrested he refused to answer any questions and continued to be abusive.

The court was told Farrell is already on a community payback order.

Sheriff Garry Sutherland banned Farrell from driving for 18 months and fined him £370. He also imposed a community payback order with 80 hours of unpaid work.
