A Dunfermline offender, who told a police officer “I’ll chop your head off” after a violent struggle, has been sentenced again more than three years after the incident.

Gideon Stewart was put on a community payback order with unpaid work but breached it.

The offence took place back on June 21 2021.

Stewart was originally put on an order with 200 hours of unpaid work in July 2021 but did not complete it.

Sheriff Susan Duff imposed a new order with the remaining 129 hours and 10 minutes plus another 30 hours to mark the breach.

Stewart, now 27 and living at Halkett Crescent, had admitted that at Inchkeith Drive and and en route to Dunfermline police station he shouted, swore, repeatedly made threats of violence to officers, repeatedly banged his head on the inside of the vehicle and repeatedly spat in the vehicle.

He resisted five police officers, struggled violently with them in an attempt to avoid being handcuffed and seized an officer by his protective vest.

Police had been called to the home of Stewart’s brother as the accused was “kicking off and under the influence” depute fiscal Azrah Yousaf told the court.

Stewart immediately became hostile to officers who had found him lying naked on a bedroom floor.

He was shouting, swearing and lunged at one of the officers, then struggled with them resulting in more officers being called to attend.

When finally in the police vehicle his threats included: “I’ll chop your head off”, “I’ll poke your eyes out” and “I’ll burn you to the ground”. A spit-hood had to be put on him.
