FIFE Council has confirmed that they are not currently taking enforcement action at the Buzz Shisha bar premises in Dunfermline because of a fresh planning appeal.
A local resident contacted the Press expressing their concerns that the site in Duncan Crescent was still being run as a controversial Shisha bar.
He said people have been coming in and out of the building and had been every night for the last three years.
Last week, he said police were called to the scene as part of ongoing disruption.
He added: "They were called because there has been incidents of the delivery drivers for the chip shop becoming blocked in and obstructed by customers and staff from the still fully operational shisha bar."

The Buzz Shisha Lounge started operating in the summer of 2022 with applicant Muhammad Arslan "unaware" that he needed planning permission from the council.
The west and central planning committee refused his retrospective application in January 2023 and the Fife planning review body upheld that decision last August.
The council began enforcement action, to effectively force the business to shut down, in December.
However, in January, Mr Arslan appealed to the Scottish Government and asked for a pause until a new application was determined.
Instead of a shisha bar, which he said had already closed, he proposed the premises be used for customers of his adjacent business, House of Desserts, to sit and eat their sweet treats.
The Scottish Government rejected the appeal in February and the application for a seating area was knocked back in June. A fresh appeal has now been made which has stalled any action by the local authority.
Fife Council service manager Alastair Hamilton explained: "The owner has appealed to the Scottish Government against the decision of Fife Council to refuse their planning application for a change of use to a cafe.
"At the present time no further formal planning enforcement action is being undertaken."
Police Scotland confirmed their attendance at the premises last weekend however say the matter was referred onto the local council.
