Two young children, aged 10 and 11, ran from a skate park when a man exposed his penis towards them.

Patrik Smolorz claimed he did not see anyone around when he urinated in front of the kids in Dunfermline.

Smolorz, 32, is formerly of Glenbervie Grove, Dunfermline, now of Dyce Way, Glenrothes.

He appeared at Dunfermline Sheriff Court with a Polish translator.

He admitted that on July 25 last year at a skate park in Queensferry Road, he committed an offence of public indecency by exposing his penis.

Depute fiscal Christine Allan said at 2.55pm two children, aged 10 and 11, were at the skate park. They saw Smolorz sitting on a bench drinking alcohol.

He then stood up and began urinating facing the skate park. He was “showing his penis and making eye contact” with the youngsters.

The children ran home and one of them called their mum who phoned the police.

At 3.30pm Smolorz was arrested and said: “I’m here first time. Normally I drink in the house. I was drinking vodka.”

He claimed that because of his level of intoxication he did not see anyone around when he urinated.

Defence solicitor Alan Davie said: “He’d been drinking to considerable excess.

“There was no good excuse for his behaviour even if no-one was there but it’s made much worse given there were young people present.

“He hopes there was no negative impact on the children. He has a long-standing problem with alcohol.

“He moved to Scotland two years ago intending to work but alcohol has got in the way of that.”

He added that Smolorz now hopes to go into a residential rehabilitation facility.

Sheriff Krista Johnston imposed a community payback order with six months of supervision.

Smolorz has not been put on the sex offenders register. This is because the Crown decided there was not a significant sexual element to the crime.
